Second Home Tenant Rental Terms and Conditions

The following outlines the agreement entered between the tenant and Second Home LLC on behalf of the property owner (host).

This is a vacation rental agreement for Florida vacation rentals. The rights and obligations of the parties to this agreement are defined by law. Your signature on this agreement, or payment of money or taking possession of the property after receipt of the agreement, is evidence of your acceptance of the agreement, and your intent to use the property for a vacation rental. Second Home LLC (Second Home), the management firm, on behalf of the owner of the property, rents the subject property to the tenant, subject to the provisions of the rental agreement.

Section A: Booking Accommodations

  1. You understand that a confirmed booking of an Accommodation is a limited license granted to you by the Host to enter, occupy and use the Accommodation for the duration of your stay, during which time the Host (only where and to the extent permitted by applicable law) retains the right to re-enter the Accommodation, in accordance with your agreement with the Host.
  2. You agree to leave the Accommodation no later than the checkout time that the Host specifies in the Listing or such other time as mutually agreed upon between you and the Host. If you stay past the agreed upon checkout time without the Host's consent (“Overstay”), you no longer have a license to stay in the Accommodation and the Host is entitled to make you leave in a manner consistent with applicable law. In addition, you agree to pay, if requested by the Host, for each twenty-four (24) hour period (or any portion thereof) that you Overstay, an additional nightly fee of up to two (2) times the average nightly Listing Fee originally paid by you to cover the inconvenience suffered by the Host, plus all applicable Guest Fees, Taxes, and any legal expenses incurred by the Host to make you leave (collectively, "Overstay Fees"). Overstay Fees for late checkouts on the checkout date that do not impact upcoming bookings may be limited to the additional costs incurred by the Host as a result of such Overstay. If you Overstay at an Accommodation, you authorize Second Home LLC to charge you to collect Overstay Fees. A Security Deposit, if required by a Host, may be applied to any Overstay Fees due for a Guest’s Overstay.
  3. Upon receipt of a booking confirmation from Second Home, LLC. a legally binding agreement is formed between you and your Host, subject to any additional terms and conditions of the Host that apply, including in particular the applicable cancellation policy and any rules and restrictions specified in the Listing. Second Home LLC will collect the Total Fees at the time of the booking request or upon the Host’s confirmation. For certain bookings, Guests may be required to pay or have the option to pay in multiple installments.
  4. You are required to ensure that every additional guest meets any requirements set by the Host and is made aware of and agrees to these Terms and any terms and conditions, rules and restrictions set by the Host. If you are booking for an additional guest who is a minor, you represent and warrant that you are legally authorized to act on behalf of the minor. Minors may only participate in an Experience, Event or other Host Service if accompanied by an adult who is responsible for them.


  1. CHECK-IN / CHECK-OUT TIMES. The check-in and check-out times will be 3:00PM EST (Check-in) and 10:00 AM EST (Check-out) unless otherwise agreed. If check-out has not occurred by 10:00 a.m., the full daily rate for our rentals may be charged to your credit card on file.
  2. PAYMENT. Payment will be accepted by valid debit card or credit card. No cash nor personal checks accepted. Half of total rental amount is due upon booking confirmation and will be applied toward total balance.
  3. FINAL BALANCE DUE DATE. Full payment of balance is due 60 days in advance of scheduled check-in date, no exceptions. Please contact us at 904-347-2440 at that time to pay your final payment, or if applicable, you can login under Guest Login on our website to pay the balance online.
  5. TRANSFER OF PREMISES. Second Home will make every effort to ensure that the property reserved is available. Second Home reserves the right to substitute comparable accommodations without prior notice or liability. When comparable accommodations are not available, guests will have the option of selecting from available properties at the published rate for such properties or receiving a complete refund.
  6. INTENDED USAGE. No House Parties/ Large Groups: If the home is booked for these purposes without explicit approval, occupancy will not be allowed and deposit forfeited. Some properties do allow groups, weddings, or reunion with an event fee. If discovered after occupancy, guests will be charged the applicable event fee or asked to vacate the premises immediately with no refund.
  7. DAMAGE CHARGES. Your credit card information will be kept on file during the term of your stay for use as a "security/damage deposit" to ensure compliance with the terms of the Rental Agreement. If, after inspection, it is determined that the condition of the rental that you inhabited is beyond normal wear and tear, or contents are missing from the unit, Tenant agrees to accept all liability and understands that these costs will be charged to the Tenant's credit card, to include an applicable administrative fee. Amounts may also be charged to cover unnecessary service calls, unreturned keys, or remotes to our rentals. Please report any problems or damage in your unit on the day of check-in. If not reported, we must assume the damages occurred during your occupancy of our rentals. Second Home’s determination of damages will be conclusive.
  8. KEYS and CODES. You agree to keep all codes for locks and access provided for the use of the rental unit as well as the use of any associated areas (pool, beach, etc.) highly confidential. You also agree to return all physical keys and controls to the unit or location provided. Failure to do so will result in additional charges equaling the costs to replace locks, replace controls or reprogram codes plus $150 administrative fee.
  9. CANCELLATION POLICIES. PLEASE REMEMBER YOUR RESERVATION HOLDS THAT UNIT IN YOUR NAME, THEREBY REMOVING IT FROM OUR INVENTORY OF AVAILABLE RENTALS. a. For cancellations 60 days before the scheduled time/day of check-in: Full Refund less a $150 cancellation fee. b. For cancellations between 59 days and 15 days before the scheduled time/day of check-in: 50% of fees will be returned c. For cancellations 14 days before the scheduled time/day of check-in: No Refund.

    Natural disasters, acts of God, inclement weather or problems could affect your visit. Second Home will attempt to accommodate you should a problem occur, but there will be no refund of the rent. PLEASE REMEMBER YOUR RESERVATION HOLDS THAT UNIT IN YOUR NAME, THEREBY REMOVING IT FROM OUR INVENTORY OF AVAILABLE RENTALS.

  10. TRANSFERS. No unit transfer by request of Tenant will be made once the reservation has been confirmed.
  11. CLEANING. Your rental unit will be thoroughly cleaned before each arrival. If you are not satisfied, please call our office within 2 hours. If you have not called within this time, we will assume you have found everything in acceptable condition. All of our rental units have a departure cleaning added to their rental rate which will include a normal cleaning of the unit. We ask only that our rental guests load any dirty dishes into the dishwasher, remove leftover food and garbage from the unit, and place all used linen in the laundry area of the unit. Each unit is inspected after every departure and renters may be charged for extra cleaning if the unit is left excessively dirty and/or if Tenant fails to do the above-listed requirements.
  12. TENANT DUTIES. Tenant agrees to comply with all obligations imposed on Tenant with respect to maintenance of the Premises, including but not limited to keeping the Premises as clean and safe as the conditions of the Premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the Premises that Tenant uses; and notifying rental office of the need of replacement or repairs to the unit. Tenant agrees not to use the Premises for any activity that violates any criminal law or governmental regulation. Tenant's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of Tenant's tenancy.
  13. AGENT DUTIES. Second Home agrees to provide the Premises in a fit and habitable condition. If at the time Tenant is to begin occupancy of the Premises, Agent cannot provide the Premises in a fit and habitable condition or substitute a reasonably comparable property in such condition, Agent shall refund to Tenant all payments made by the Tenant. (Exceptions: hurricane damage/evacuation) Second Home shall conduct all brokerage activities in regard to this Rental Agreement without respect to the race, color, religion, sex, national origin, handicap or familial status of any tenant.
  14. MANDATORY EVACUATION. If State or local authorities order a mandatory evacuation of an area that includes the Premises, Tenant shall comply with the order.
  15. EXPEDITED EVICTION. If the tenancy created hereunder is for 30 days or less, expedited eviction procedures will apply. Tenant may be evicted under such procedures if Tenant: (i) holds over in possession after Tenant's tenancy has expired; (ii) commits a material breach of any provision of this Agreement (including any addendum hereto) that according to its terms would result in the termination of Tenant's tenancy; (iii) fails to pay rent as required by this Agreement; or (iv) has obtained possession of the Premises by fraud or misrepresentation.
  16. INDEMNIFICATION AND HOLD HARMLESS; RIGHT OF ENTRY; ASSIGNMENT. Tenant agrees to indemnify and hold harmless Agent and the owner from and against any liability for personal injury or property damage sustained by any person (including Tenant's guests) as a result of any cause unless caused by the negligent or willful act of Agent or the Owner. Tenant agrees that Agent, the Owner or their respective representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations, or improvements thereto as Agent or Owner may deem appropriate. Tenant shall not assign this Agreement to sublet the Premises in whole or part without written permission of the Agent.
  17. PETS. Second Home does have "pet-friendly" units. IF A UNIT DOES NOT SPECIFICALLY ALLOW PETS and Tenant is found to have a pet in Tenant's unit at any time during Tenant's stay, Tenant's tenancy shall be terminated and a mandatory additional cleaning charge of no less than $300 will be charged to Tenant's credit card on file, plus an applicable administration fee of $75.00.
  18. SMOKING FEE. All units are NON SMOKING!!! Smoking is STRICTLY PROHIBITED inside all rentals. Tenant will be charged a $300 additional cleaning fee to Tenant's credit card on file if evidence of smoking is found.
  19. REPAIRS AND SERVICE CALLS. Second Home cannot guarantee against the breakdown of air conditioning or other appliances. Please report any non-operative equipment promptly. Every effort to have repairs done quickly and efficiently will be made. Should a repairman make a call to a unit and find that the equipment is in working order and the problem was due to tenant oversight or neglect, then – at the discretion of Second Home - all or some of the charges for the service may be charged to the Tenant's credit card on file. No rental refunds will be made due to the failure of air conditioning, other appliances or items beyond our control.
  20. UNIT TELEPHONE. Should any property have a wired telephone unit then these are for local use only. Any other usage will incur additional fees.
  21. TV Usage and Internet Usage. The units may have access to a range of cable TV or related TV options. Every attempt will be made to lock the use of access to paid content. However, you retain responsibility for all of the guests in the house should any of them make purchases that are charged to the Host’s account plus an administration fee of $75.00. Furthermore, should the wireless password for the router or other appliances get changes by you or your guests, a further $75.00 administration fee will be charged.
  22. The GUEST understands that the accommodation is privately owned, including the furnishings, and neither Second Home nor the Owner shall be responsible for providing any additional furnishings or equipment not available presently on the Premises. Certain areas, such as locked closets designed with each unit, are reserved for the exclusive use of the Owner and will not be available for the use of the Tenant. All decor and service items in the unit are privately owned and provided. Please respect them as you would your own property. DO NOT REARRANGE FURNISHINGS OR LEAVE ANY FURNISHINGS OUTDOORS (EXCLUDING DECK FURNITURE).
  23. RENTAL DAMAGE PLAN. Second Home does not provide a vacation rental damage or travel insurance plan. Please seek third-party companies for various travel insurance and damage insurance plans.
  24. MINIMUM STAY: Some rental unit have a Minimum Stay requirement per their bylaws. Minimum stay requirements vary and will be quoted at time of reservation.
  25. AGE REQUIREMENTS. Second Home does not rent to anyone under the age of 21. Any reservation made under false pretenses will be subject to forfeiture of advance payment, deposit, and/or rental money. Violators will be evicted with no refund. Some complexes have different age requirements that we are required to comply with. Please check with Second Home prior to confirming booking.
  26. CAMPERS, TRAILERS, BOATS, MOTOR HOMES OR RECREATIONAL VEHICLES. It MAY be possible to bring these items to certain units. Please contact Second Home prior to booking. Most condo rentals do not allow for parking of above listed items and tenant will be required to remove at tenant's expense.
  27. SWIMMING POOL: NO LIFEGUARDS ON DUTY. Guests assume all liability for use of pools, spas, and similar fixtures. Tenant and guests agree to hold Second Home and any affiliated company free from liability for the use of any swimming pools or hot-tubs.
  28. LINENS, SUPPLIES, GRILLS. An initial linen supply will be provided. The beds will be made and a change of linens is available in each unit.
  29. Supplies & Appliances (minimum):
    • Kitchenware, utensils, dishes, and cookware.
    • Air conditioning and heat.
    • At least one TV.
    • Full kitchen including microwave, oven, and refrigerator.
    • Washer and dryer.
    • Some rental units have grills and some properties prohibit grills at the unit. Please check with reservationist at time of booking if a grill is available. Charcoal grills are prohibited on decks, porches and balconies of most condos. Please see individual descriptions from amenities of each property.
  30. Second Home, LLC., is NOT responsible for articles lost, stolen, or left behind in the rental units.

Section C: Booking Modifications, Cancellations and Refunds,

  1. Guests are responsible for any modifications to a booking that they make via the platform used by Second Home LLC or that they direct Second Home LLC customer service to make ("Booking Modifications"), and agree to pay any additional Listing Fees, Host Fees or Guest Fees and/or Taxes associated with such Booking Modifications.
  2. Guests can cancel a confirmed booking at any time pursuant to the Listing’s cancellation policy, and Second Home LLC will refund the amount due to the Guest in accordance with such cancellation policy.
  3. If a Host cancels a confirmed booking, the Guest will receive a full refund of the fees for such a booking within a commercially reasonable time of the cancellation. In some instances, Second Home LLC may allow the Guest to apply the refund to a new booking, in which case Second Home LLC will credit the amount against the Guest’s subsequent booking at the Guest’s direction. Further, Second Home LLC may publish an automated review on the Listing canceled by the Host indicating that a booking was canceled. In addition, Second Home LLC may (i) keep the calendar for the Listing unavailable or blocked for the dates of the canceled booking, and/or (ii) impose a cancellation fee, unless the Host has a valid reason for canceling.
  4. For Experiences, Events and other Host Services, if inclement weather creates an unsafe or uncomfortable scenario for Guests, Hosts may modify or cancel a Host Service. If there is a substantial change in the itinerary or the Host Service needs to be canceled, Second Home LLC will work with the Host and/or Guests to provide Guests an alternative date for the Host Service, an appropriate refund or a rebooking.
  5. In certain circumstances, Second Home LLC may decide, in its sole discretion, that it is necessary to cancel a confirmed booking and make the appropriate refund and payout decisions. Where Second Home LLC believes in good faith while taking the legitimate interests of both parties into account, this is necessary to avoid significant harm to Second Home LLC, other Members, third parties or property, or (ii) for any of the reasons set out in these Terms.
  6. If a Guest suffers a serious travel hindrance or extreme medical Issue and can be supported through documentation, Second Home LLC. may determine, in its sole discretion, to refund the Guest part or all of the fees.

Section D: Taxes

  1. You understand that any appropriate governmental agency, department and/or authority ("Tax Authority") where your Accommodation is located may require Taxes to be collected from Guests or Hosts on Listing Fees and to be remitted to the respective Tax Authority. The laws in jurisdictions may vary, but these Taxes may be required to be collected and remitted as a percentage of the Listing Fees set by Hosts, a set amount per day, or other variations, and are sometimes called "transient occupancy taxes," "hotel taxes," "lodging taxes," "city taxes," "room taxes" or "tourist taxes" ("Occupancy Taxes")
  2. In certain jurisdictions, Second Home, LLC. may decide in its sole discretion to facilitate collection and remittance of Occupancy Taxes from or on behalf of Guests or Hosts, in accordance these Terms ("Collection and Remittance") if such jurisdiction asserts Second Home LLC or Hosts have an Occupancy Tax collection and remittance obligation. In any jurisdiction in which we decide to facilitate direct Collection and Remittance, you hereby instruct and authorize Second Home LLC (via Second Home LLC ) to collect Occupancy Taxes from Guests on the Host's behalf at the time Listing Fees are collected, and to remit such Occupancy Taxes to the Tax Authority. The amount of Occupancy Taxes, if any, collected and remitted by Second Home LLC will be visible to and separately stated to both Guests and Hosts on their respective transaction documents. Where Second Home LLC is facilitating Collection and Remittance, Hosts are not permitted to collect any Occupancy Taxes being collected by Second Home LLC relating to their Accommodations in that jurisdiction.
  3. You agree that any claim or cause of action relating to Second Home LLC facilitation of Collection and Remittance of Occupancy Taxes shall not extend to any supplier or vendor that may be used by Second Home LLC in connection with facilitation of Collection and Remittance if any. Guests and Hosts agree that we may seek additional amounts from you in the event that the Taxes collected and/or remitted are insufficient to fully discharge your obligations to the Tax Authority and agree that your sole remedy for Occupancy Taxes collected is a refund of Occupancy Taxes collected by Second Home LLC from the applicable Tax Authority in accordance with applicable procedures set by that Tax Authority.

Section E: Website and Related Terms

Second Home, LLC. requires that all persons or entities visiting any Second Home LLC Sites on the World Wide Web ("Sites") agree to the following terms and conditions. By accessing a Site, you confirm your agreement to and acceptance of these terms.

  1. se of Information Unless otherwise specified, copyright in all copyrightable subject matter on any Site is owned by Second Home, LLC. To the extent that Second Home, LLC. has the right to do so without compensation to third parties, and except for materials or information specifically provided under other terms, Second Home LLC grants you permission to copy or otherwise download from any Site, information, and materials (including related graphics), provided: 1. The materials are for internal, non-commercial use only, and 2. Any copies of materials or portions thereof must include the copyright notice specified on the Site. If attribution to Second Home LLC is included, limited quotations from the content are hereby permitted. You may not copy or display for redistribution to third parties for commercial purposes any portion of the content without the prior written permission of Second Home, LLC. Documents posted by Second Home LLC on a Site may contain other proprietary notices or describe products, services, processes or technologies owned by Second Home LLC or third parties. Nothing contained herein shall be construed by implication, estoppels or otherwise as granting to the user a license under any copyright, trademark, patent or other intellectual property right of Second Home LLC or any third party.
  2. Trademarks The Second Home LLC name and logo and all related product and service names, design marks and slogans are trademarks, service marks or registered trademarks of Second Home LLC and may not be used in any manner without the prior written consent of Second Home, LLC. Other products and service marks are trademarks of their respective owners.
  3. Consent to Monitoring and Disclosure Second Home LLC is under no obligation to monitor the information residing or transmitted to this site. However, anyone accessing this site agrees that Second Home LLC may monitor the site to (1) comply with any necessary laws, regulations or governmental requests; (2) to, in its sole discretion, operate the Site in a manner it deems proper or to protect against conduct it deems inappropriate. Second Home LLC shall have the right but not the obligation, to reject or eliminate any information residing on or transmitted to the Site that it, in its sole discretion, believes is unacceptable or inconsistent with these terms and conditions. In the event Second Home LLC receives information or materials through the Site, including but not limited to feedback, data, answers, questions, comments, suggestions, plans, ideas or the like, such information or material shall be deemed to be non-confidential and Second Home LLC assumes no obligation to protect same from disclosure. The submission of information or materials to Second Home LLC shall in no way prevent the purchase, manufacture or use of similar products, services, plans and ideas by Second Home LLC for any purpose whatever. In addition, you grant Second Home LLC the right, in any form now or hereafter known, to reproduce, use, disclose, distribute, transmit, create derivative works from, and publicly display and perform, any information or materials you submit to through any Site.
  4. Limitation of Liability You assume all responsibility and risk for the use of this site and the Internet generally. In no event shall Second Home LLC or its affiliates be liable for any direct, special, indirect, or consequential damages or any damages whatsoever; including but not limited to loss of use, data, or profits, without regard to the form of any action, including but not limited to contract, negligence, or other tort actions, arising out of or in connection with the use, copying, or display of the content resulting from access to or use of this site, or the Internet generally, under contract, tort or any other cause of action or legal theory.
  5. Although Second Home LLC believes the content to be accurate, complete, and current, Second Home LLC makes no warranty as to the accuracy, completeness or currency of the content. It is your responsibility to verify any information before relying on it. The content of this site may include technical inaccuracies or typographical errors. From time to time, changes are made to the content herein. Second Home LLC may make changes in the products and/or the services described herein at any time.
  6. Endorsements and Linked Sites Some of the sites listed as links herein are not under the control of Second Home, LLC. Accordingly, Second Home LLC makes no representations whatsoever concerning the content of those sites. The fact that Second Home LLC have provided a link to a site is NOT an endorsement, authorization, sponsorship, or affiliation by Second Home LLC with respect to such site, its owners, or its providers. Second Home LLC is providing these links only as a convenience to you. Second Home has not tested any information, software, or products found on these sites and therefore cannot make any representations whatsoever with respect thereto. There are risks in using any information, software, or products found on the Internet; and Second Home LLC cautions you to make sure that you completely understand these risks before retrieving, using, relying upon, or purchasing anything via the Internet.
  7. Security You agree that you will comply with any security processes and procedures (such as passwords) specified by Second Home LLC with respect to access to or use of the Site. Further, you agree not to access or attempt to access any areas of or through a Site which are not intended for general public access, unless you have been provided with explicit written authorization to do so by Second Home, LLC.
  8. Changes and Other Terms Second Home LLC has the right to make changes and updates to any information contained within this site without prior notice. Second Home LLC reserves the right to change any of the Terms of Use without prior notice. Access to particular areas on the site may be subject to additional or different terms and conditions, as specified by Second Home LLC from time to time.
  9. Failure to Comply Second Home, LLC has the right to terminate or restrict your access to any or all Sites, unilaterally and without notice, in the event you violate any of these Terms of Use. Second Home LLC also reserves any and all remedies at law or equity in connection with violation of these Terms of Use.
  10. Information Provided by You Any information provided by you to Second Home, LLC, including but not limited to feedback, data, questions, comments, suggestions, or the like, shall be deemed to be non-confidential. Second Home LLC shall have no obligation of any kind with respect to such information and shall be free to reproduce, use, disclose, and distribute the information to others without limitation. Additionally, Second Home LLC shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products incorporating such information.
